Terms and Conditions
Last updated: 8 October 2026
1. Who we are and what these Terms cover
These Terms and Conditions ("Terms") govern access to and use of the Bottles online auction marketplace, available at bottles.pt and through the Bottles mobile applications (together, the "Platform"). The Platform is operated by BOTTLES EU LDA, a limited liability company incorporated in Portugal ("Bottles", "we", "us", "our"). Registered office: Rua Comandante Amorim, Bloco 3, N.º 106, Arrifana, 3700-423 São João da Madeira, Aveiro, Portugal. Tax and company number: 518 377 385. Email: info@bottles.pt. Customer support: Portuguese line +351 914 021 381; English line +1 973 975 6042; French line +33 6 88 90 74 26. These Terms form a binding agreement between you and Bottles. They are completed by the Buyers Policy, the Sellers Policy, the Privacy Policy and the Cookie Policy, which are incorporated by reference. If a policy conflicts with these Terms, the policy prevails for the matter it specifically regulates. Help centre articles and in-app explanations are guidance only; these Terms and the policies prevail over them. By creating an account, placing a bid, listing an item or otherwise using the Platform, you accept these Terms. If you do not accept them, do not use the Platform. These Terms are written in English. Translations may be provided for convenience, including machine translations; if a translation differs from the English text, the English text prevails, except where the mandatory law of your country of residence requires otherwise.

3. Where Bottles operates
The Platform can be accessed and an account can be opened from anywhere in the world. Transport, however, is arranged only within the Delivery Area: a Lot can be collected only from an address in the Delivery Area, and a Lot can be delivered only to an address in the Delivery Area. You may bid only if you can receive the Lot at an address in the Delivery Area, and you may sell only if the Lot is held at an address in the Delivery Area from which it can be collected. You are responsible for confirming that using the Platform, and buying, selling, receiving or holding alcohol, is lawful for you under the laws that apply to you, including the laws of your country of residence and of the delivery or collection address. Bottles does not offer the Platform where doing so is unlawful, and does not deal with persons or entities subject to sanctions imposed by the European Union, the United Nations or Portugal. Bottles may restrict or withdraw the Platform in a country at any time where the law or its carriers require it.
4. Eligibility and your account
You must be at least 18 years old, or older if the law of your country of residence or of the delivery address sets a higher minimum age for buying or receiving alcohol. You confirm this when you register and each time you bid or list. Giving a false date of birth is a breach of these Terms and leads to closure of the account. You must provide accurate, complete and current information, and keep it updated, including after you stop using the Platform while any payment, refund or delivery is outstanding. Bottles may ask for proof of identity, age, address, ownership or source of funds at any time, in particular for high-value bids, and may suspend an account or refuse a bid until it is provided. Sellers must complete identity verification with our payment provider, Stripe, before their first payout. Bottles does not receive the underlying identity documents. A Seller declares, during identity verification with Stripe, whether they sell as an individual or as a business. A Seller who verifies as a business, or who otherwise tells Bottles that they sell in the course of a trade, is a Trader Seller; every other Seller is a Private Seller. A Lot shows when its Seller is a Trader Seller. Where the Seller is a Private Seller, European Union consumer protection law does not apply to the contract between Buyer and Seller. A Seller who sells in the course of a trade while verified as an individual must tell Bottles; a false status makes the Seller liable for the consequences and the Seller indemnifies Bottles against them. You may hold one account only, in your own name. You may not transfer your account, bid or buy for an undisclosed third party, or let anyone else use it. You are responsible for everything done through it, including bids. Keep your credentials confidential and tell us at once at info@bottles.pt if you suspect unauthorised use. You may close your account at any time in the app or on the web. Bottles may refuse the closure until you have performed outstanding obligations, including payment for a Lot you have won and collection of a Lot you have sold. Closing an account does not release you from those obligations. Bottles may suspend or close an account, refuse a registration or restrict features where these Terms or a policy are breached, where fraud, manipulation or unlawful conduct is suspected, where identity or tax information is not provided, where you become insolvent, where the law requires it, or where an Bottles - Terms and Conditions · BOTTLES EU LDA2 / 10
account has been inactive for more than 24 months. Except where immediate action is required by law or to prevent harm, Bottles gives notice and a statement of reasons. Section 15 sets out the additional notice owed to Trader Sellers.
5. Our role
Bottles operates an online marketplace. Each sale is concluded directly between the Buyer and the Seller. Bottles is not the seller of any Lot, is not a party to the contract of sale and does not take title to any Lot. Bottles provides the auction mechanism, a review of every Lot by a Specialist before publication, collection of the Buyer's payment on the Seller's behalf, the booking of transport, and a dispute procedure. Bottles does not guarantee the authenticity, provenance, condition, quality or value of any Lot. The Specialist's review is carried out with reasonable care and in good faith, is based on the information and photographs supplied by the Seller and, where the Specialist sees fit, on a physical inspection, and does not transfer the Seller's responsibility for the Lot to Bottles or to the Specialist. Bottles may at any time ask that a Lot be sent to a Specialist for inspection before publication, or inspect a Lot after a sale, at its own cost where Bottles requests it. Where Bottles books transport for a sold Lot, it does so as a service to the Seller, in the Seller's name and on the Seller's behalf. For all legal and tax purposes, including excise, the Seller is the consignor of the Lot. Bottles does not buy, own, store or dispatch any Lot. Estimates, starting prices, past prices and market data shown on the Platform are indicative and are not a valuation, a promise of value or investment advice. Lots are not financial products; anyone who buys for investment does so at their own risk. For the purposes of Regulation (EU) 2022/2065 (Digital Services Act), Bottles is a hosting service provider and an online platform allowing consumers to conclude distance contracts with traders. Bottles is not obliged to monitor content Users upload, but acts on notices under section 13.
6. How an auction works
A Seller creates a listing. A Specialist reviews it and may approve it, ask for more information or photographs, adjust the description or decline it. The Lot is published only after approval. The Seller may set a reserve price. A Lot without a reserve sells to the highest bid, whatever its amount. Whether a Lot has a reserve is shown on the Lot. The starting price is set by the Platform. Bids are placed in fixed increments: 10% of the current bid, rounded up to the euro, while the current bid is below EUR 5,000; EUR 500 from EUR 5,000; EUR 1,000 from EUR 10,000. The Platform shows the minimum next bid. A Buyer may set a maximum bid. The Platform then bids on the Buyer's behalf, one increment at a time, only when another bid is placed and never above the maximum. Between competing maximum bids, the one set earlier prevails at equal amounts. Soft close: a bid placed in the last 2 minutes of an auction extends the closing time by 5 minutes. Each further bid in the extended time extends it again by 5 minutes. The Lot page always shows the current closing time. A bid is a binding offer to buy the Lot at that amount. It cannot be amended or withdrawn. The one exception: if the Lot description is materially corrected after the bid was placed, the Buyer may ask Bottles to cancel the bid before the auction closes. Bottles is not responsible for a bid placed in error. Bottles - Terms and Conditions · BOTTLES EU LDA3 / 10
When the auction closes with a highest bid at or above the reserve, a contract of sale is formed between that Buyer and the Seller at the Hammer Price. Bottles notifies both parties. The Bidding Log prevails over anything displayed on a screen or sent by notification. Where a technical failure, a bid placed by mistake, manipulation or a breach of these Terms affects an auction, Bottles may refuse or remove a bid, pause, extend, restart or cancel an auction, or annul a sale and award the Lot to the correct highest bidder. Bottles informs the affected Users and refunds any payment made, including the buyer's fee, and is not liable for further loss. Bottles decides, on the basis of the Bidding Log, who placed the highest valid bid. That decision is final on the Platform.
7. How Lots are ordered and shown
This section is provided to all Users under Article 6a of Directive 2011/83/EU and to Trader Sellers under Regulation (EU) 2019/1150. Lots are ordered on the Platform mainly by closing time, activity (number of bids and followers), recency of publication and relevance to the User's search terms, filters and browsing on the Platform. Bottles does not sell ranking positions and does not offer paid placement. Lots that were physically verified by a Specialist, or that have no reserve, may be highlighted. Curated selections and editorial features are chosen by Bottles staff on quality and relevance. Bottles does not sell Lots on its own account and does not apply personalised pricing. Ratings of Sellers and Specialists come only from Buyers who completed an order for a Lot of that Seller or reviewed by that Specialist. Bottles does not buy or write reviews, and may remove a review that is abusive, unlawful or unrelated to the transaction.
8. The contract of sale between Buyer and Seller
The following terms form part of every contract of sale concluded on the Platform. The parties may not change them. The Seller sells and the Buyer buys the Lot as described on the Lot page at the Hammer Price. The Buyer pays the Hammer Price to Bottles, which receives it on the Seller's behalf. Payment to Bottles discharges the Buyer's payment obligation to the Seller. Delivery is made by the carrier booked by Bottles, from the Seller's collection address to the Buyer's delivery address. The Seller's obligation is to pack the Lot and hand it to the carrier; the Buyer's is to receive it. Title to the Lot passes to the Buyer on delivery, provided the Hammer Price has been paid. Risk of loss or damage passes to the Buyer on delivery. The Buyer may raise a claim for non-delivery, damage in transit, counterfeit or material misdescription through the dispute procedure within the periods in the Buyers Policy. Where the Seller is a Trader Seller and the Buyer a Consumer, the Consumer also has the legal guarantee of conformity under the law of the Consumer's residence, which the Trader Seller cannot exclude. Features of a bottle that were disclosed in the description or that are normal for its age are not a lack of conformity. Where a party fails to perform, the other party, or Bottles on its behalf, may set a reasonable deadline and, if it is not met, cancel the sale. The party at fault bears the costs and losses caused, including fees due to Bottles. Bottles - Terms and Conditions · BOTTLES EU LDA4 / 10
Both parties grant Bottles the right, as a third-party beneficiary of the contract of sale, to cancel the sale in the cases set out in these Terms and the policies, and an irrevocable mandate to declare such cancellation, to refund the Buyer and to relist the Lot on the Seller's behalf.
9. Buyers, in short
The Buyer pays the Hammer Price, the buyer's fee, transport and any applicable taxes within 72 hours of the close of the auction, through the Platform. A Buyer who does not pay in time loses the Lot, receives a non-payment strike and may be suspended. The Seller may offer the Lot to the second-highest bidder, who has 24 hours to accept at their own final bid. The Buyer inspects the Lot on arrival and reports any problem through the Platform within 48 hours of delivery. After that period, receipt is deemed confirmed and payment is released to the Seller. The full rules are in the Buyers Policy.
10. Sellers, in short
The Seller must be the legal owner of the Lot, entitled to sell it, and must describe it truthfully and completely. While a Lot is listed on Bottles it may not be offered for sale elsewhere. Once the Buyer has paid, Bottles books a carrier to collect the Lot. The Seller packs it securely and makes it available in the collection window chosen in the app. The Seller does not ship the Lot or upload tracking. Bottles pays the Seller after the Buyer confirms receipt or 48 hours after delivery without a dispute, less the commission and its VAT. The full rules are in the Sellers Policy.
11. Fees, payments and currency
Buyer's fee: 6% of the Hammer Price, plus VAT where applicable, invoiced by Bottles to the Buyer at payment. Transport: the carrier's price for delivery to the Buyer's address, plus VAT where applicable, shown to the Buyer before payment. Seller's commission: 9% of the Hammer Price, plus VAT where applicable, invoiced by Bottles to the Seller and deducted from the payout. No commission is charged if a Lot does not sell. The Hammer Price is owed by the Buyer to the Seller. Bottles invoices only its own fees. Any invoice for the Lot itself is the Seller's responsibility. Fees due to Bottles remain due when a sale is cancelled for a reason attributable to the party that owes them, and Bottles may claim its fees from the party at fault. All amounts on the Platform are in euro. If your payment method is denominated in another currency, your bank or card issuer converts the amount and may charge a fee. Payments are processed by Stripe Payments Europe, Ltd. and its affiliates under the Payment Services Directive (EU) 2015/2366. Bottles does not receive or store card numbers. Sellers receive payouts through Stripe Connect, in euro, to the account registered with Stripe. Bottles may set off any amount you owe it against any amount it owes you, including payouts and refunds. Bottles - Terms and Conditions · BOTTLES EU LDA5 / 10
Bottles may change its fees. A change applies to auctions that start after it is published, never to an auction already running, and is announced in accordance with section 22.
12. Transport
Bottles arranges transport of every sold Lot through a professional carrier, on behalf of the Seller as described in section 5, from the Seller's collection address to the Buyer's delivery address, both within the Delivery Area. Bottles is not the carrier. The Seller is responsible for packing suited to glass and liquids; the Buyer is responsible for being available at the delivery address or for arranging redelivery with the carrier. Transport booked by Bottles includes the carrier's cover for loss and breakage up to the value declared at booking; loss or damage in transit is handled through the dispute procedure, as described in the Buyers Policy and the Sellers Policy. Bottles is not liable for carrier delays, and may postpone collection in periods of extreme heat or cold to protect the Lot. Bottles does not arrange transport to or from any address outside the Delivery Area, and does not act as importer, exporter, customs agent or tax representative for anyone. A User who gives incorrect information that leads to a seizure, a customs charge or a failed delivery bears the consequences.
13. Right of withdrawal and consumer information
Sales by a Private Seller: the contract is between two private persons. The statutory right of withdrawal and the other consumer rights under Directive 2011/83/EU do not apply to that contract. Sales by a Trader Seller to a Consumer: Bottles operates a public auction within the meaning of Article 2(13) of Directive 2011/83/EU, in which Lots are offered through a transparent competitive bidding procedure run by Bottles, and the sale is therefore exempt from the right of withdrawal under Article 16(k) of that Directive. If, notwithstanding this, the mandatory law that applies to the Consumer grants a right of withdrawal, that right is exercised against the Trader Seller, who bears its consequences, and Bottles refunds its buyer's fee for the Lot returned. In every case, the Buyer has the protections of the dispute procedure for non-delivery, loss or damage in transit, counterfeit and material misdescription. Nothing in these Terms limits rights that the mandatory law of a Consumer's country of residence grants and that cannot be waived by contract.
14. Prohibited conduct and notices
You must not: list, bid on or sell counterfeit, adulterated, refilled, stolen or unlawfully obtained goods, or goods whose sale or shipment is prohibited or restricted; provide false, misleading or incomplete information in a listing, a profile, a bid or a dispute; bid on your own Lot, directly or through another person, or otherwise manipulate bids, prices, ratings or reviews; contact another User to conclude a sale outside the Platform, or circumvent the Platform's fees; if another User proposes this, report it; open more than one account, use another person's account, or act as nominee for an undisclosed third party; use another User's personal data for any purpose other than completing the transaction with that User; Bottles - Terms and Conditions · BOTTLES EU LDA6 / 10
scrape, copy, reverse engineer or interfere with the Platform, or use it with automated tools not provided by Bottles; harass, threaten or defraud another User or Bottles staff; use the Platform for money laundering, sanctions evasion or any unlawful purpose. Anyone may notify Bottles of content they consider illegal or in breach of these Terms by writing to info@bottles.pt with the address of the content and the reasons. Bottles reviews notices without undue delay, informs the person who submitted the content of any decision and of the reasons, and offers the possibility to contest it through the complaint procedure in section 15 or, for other Users, by reply to the decision. Bottles may refuse a notice that is manifestly unfounded. Bottles may remove content, suspend accounts, withhold payments and report unlawful conduct to the competent authorities, including law enforcement and customs.
15. Trader Sellers: additional terms
This section applies to Trader Sellers and implements Regulation (EU) 2019/1150. Ranking and differentiated treatment are described in section 7. Changes to these Terms that affect Trader Sellers are notified at least 15 days before they take effect, or longer where the change requires technical or commercial adaptation. A Trader Seller may terminate the relationship before the change takes effect. Restriction, suspension or termination: Bottles gives a statement of reasons, on a durable medium, at the latest when the measure takes effect, and 30 days before termination except where a legal or regulatory obligation, a repeated breach or a serious risk requires otherwise. Complaints: Trader Sellers may complain about a decision, a technical issue or a measure at info@bottles.pt. Bottles handles complaints free of charge, within a reasonable time, and communicates the outcome individually. Complaints must be raised within 6 months of the event. Mediation: Bottles is willing to engage with the Centro de Arbitragem Comercial da Câmara de Comércio e Indústria Portuguesa (Lisbon) to mediate disputes with Trader Sellers that cannot be resolved through the complaint procedure. Each party bears a reasonable share of the costs. Trader Sellers must supply, and keep updated, the information Bottles needs under Article 30 of Regulation (EU) 2022/2065: name, address, telephone and email, registration and, where applicable, VAT number, a self-certification of compliance with EU law for the goods offered, and payment account details. Bottles may suspend a Trader Seller who does not supply it. A Trader Seller may apply its own terms of sale to a Lot only if they are stated in the Lot description and do not conflict with these Terms or the policies. In case of conflict, these Terms prevail.
16. Content and intellectual property
You keep ownership of the photographs, descriptions and other content you upload. You grant Bottles a non-exclusive, royalty-free, worldwide licence to host, reproduce, adapt, translate and display that content for the operation, promotion and archiving of the Platform, including the record of past sales and market data, for as long as the content is relevant to that purpose, and you agree not to assert moral rights against that use. You confirm that you hold the rights needed to grant this licence and that the content is your own; you may not copy another Seller's description or photographs. The Platform, its software, design, databases, trade marks and logos belong to Bottles or its licensors. You may not use them except as needed to use the Platform. Bottles - Terms and Conditions · BOTTLES EU LDA7 / 10
Machine translations of listings and messages are provided for convenience and may be inaccurate. The original text prevails.
17. Taxes, excise and reporting
Each User is responsible for their own taxes. Sellers are responsible for declaring their income and for any VAT due on the sale of a Lot. Trader Sellers are responsible for any excise formalities that apply to a distance sale of alcohol between Member States. Alcohol moved between Member States of the European Union may be subject to excise duty in the country of destination. Because transport is booked through the Platform, a sale by a Trader Seller to a Consumer in another Member State is a distance sale of excise goods, and excise duty is due in the country of destination (Article 44 of Council Directive (EU) 2020/262; Court of Justice of the European Union, Case C- 596/23). The Trader Seller is the person liable for that duty and for the formalities that go with it, including any registration, guarantee, tax representative and declaration required in the country of destination, and for any VAT due there on the sale. A Trader Seller must not accept a sale for which it cannot meet these obligations. A Private Seller confirms that each sale is an occasional sale from a personal collection and is not made in the course of an economic activity. Where the Seller is a Private Seller, the Buyer is responsible for any duty the destination country charges. Bottles does not collect, declare or pay excise duty or VAT on the sale of a Lot for anyone, and does not act as tax representative for anyone. The Seller indemnifies Bottles against any excise duty, VAT, interest, penalty or cost claimed from Bottles in connection with the Seller's sales. To comply with excise or alcohol law, Bottles may restrict categories of beverage, countries of destination or Sellers for sales between Member States. Bottles is a platform operator under Council Directive (EU) 2021/514 (DAC7). Where a Seller reaches the thresholds set by that Directive, Bottles reports the Seller's identity, tax identification number, address and sales to the Portuguese tax authority once a year. Bottles asks Sellers for their tax identification number and country of tax residence for this purpose, in the account's tax information or when they list; identity is verified by Stripe. A Seller who does not provide them when asked may have payouts withheld and the account closed, as the Directive requires.
18. Data protection
Bottles processes personal data as data controller under Regulation (EU) 2016/679, as described in the Privacy Policy, and uses cookies and similar technologies as described in the Cookie Policy. Users outside the European Economic Area have the same rights under those documents. Where a Buyer raises a reasonable claim of counterfeit, misdescription or third-party ownership after payment has been released, Bottles may disclose the Seller's name and contact details to the Buyer so that the claim can be pursued, and to the authorities.
19. Liability
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud, for wilful misconduct or gross negligence, or the rights of Consumers under mandatory law. Bottles - Terms and Conditions · BOTTLES EU LDA8 / 10
Bottles is not liable for the acts or omissions of Buyers, Sellers or carriers, for the authenticity, condition or value of a Lot, for a Seller's failure to make a Lot available or a Buyer's failure to pay, for errors in estimates or market data, for the outcome of a dispute decided in good faith, or for content Users upload, except as required by law. The Platform is provided with reasonable care and skill. Bottles does not warrant uninterrupted or error-free availability and may suspend the Platform for maintenance, security or legal reasons, giving notice where practicable. Bottles is not liable for a bid that could not be placed because of a technical failure; an auction interrupted by a failure attributable to Bottles is extended or rerun. Subject to the first paragraph of this section, Bottles' total liability to a User for all claims arising in any 12-month period is limited to the fees that User paid to Bottles in that period, or EUR 500 if higher. Bottles is not liable for indirect or consequential loss, loss of profit, loss of opportunity or decrease in the value of a Lot. This limitation extends to Bottles' directors, employees, Specialists and agents. Bottles is not liable for a failure caused by events outside its reasonable control, including failures of carriers, payment providers or telecommunications, strikes, epidemics, extreme weather or acts of authority.
20. Indemnity
To the extent permitted by law, you indemnify Bottles, its directors, employees, Specialists and agents against claims, losses, fines and costs, including reasonable legal fees, arising from your breach of these Terms or a policy, your unlawful conduct, a false declaration of Seller status, a Lot you sold, content you uploaded, or a dispute between you and another User or a third party. This does not apply to Consumers where the mandatory law of their country of residence prohibits such a clause.
21. Disputes between Users, and dispute resolution with Bottles
A Buyer or Seller may open a dispute on the Platform within the periods set in the Buyers Policy and the Sellers Policy. Buyer and Seller first try to agree a solution through the order conversation. Failing that, Bottles decides on the basis of the Bidding Log, tracking data, photographs and video, the Specialist's report and the messages exchanged on the Platform. The decision determines what happens on the Platform: refund in full or in part, release or withholding of payment, return of the Lot. It does not prevent either party from bringing the matter before a court or an alternative dispute resolution body. Users agree to cooperate in good faith, to keep documents proving ownership, authenticity and provenance for as long as a claim is possible, and not to initiate a chargeback with their bank before the dispute procedure has concluded. A User who receives a refund and also keeps the Lot, obtains a chargeback in addition to a refund, or fails to return a Lot after a refund, must reimburse Bottles on first request. Complaints about Bottles itself are handled by customer support at info@bottles.pt. Consumers may also apply to a consumer dispute arbitration centre. In Portugal the centres are listed at www.consumidor.gov.pt; for online purchases the Centro Nacional de Informação e Arbitragem de Conflitos de Consumo (CNIACC, www.cniacc.pt) has competence throughout the country, and Bottles takes part in arbitration where the law requires it. Consumers in other EU countries may apply to the alternative dispute resolution body designated in their country. The electronic complaints book is available at www.livroreclamacoes.pt. Bottles - Terms and Conditions · BOTTLES EU LDA9 / 10
22. Governing law and jurisdiction
These Terms and any dispute between you and Bottles are governed by the law of Portugal. If you are a Consumer, you also have the protection of the mandatory provisions of the law of your country of residence. The courts of Portugal have jurisdiction. If you are a Consumer resident in the European Union, you may also bring proceedings in the courts of your country of residence, and Bottles may bring proceedings against you only there.
23. Changes to these Terms
Bottles may amend these Terms and its policies. The current version is always available on the Platform with its date. Changes that only correct errors, reflect legal requirements or add features take effect on publication. Changes that affect fees, deadlines, the auction rules or your rights are announced at least 15 days in advance by email or in-app notice, and you are asked to accept the new version before you next bid or list. If you do not accept, you may close your account; the Terms in force when a sale was concluded continue to govern that sale. This version was published on 8 October 2026 and applies to Consumers and Private Sellers on acceptance. For Trader Sellers it takes effect on 23 October 2026; until then the previous version applies to them.
24. General
If a provision of these Terms is held invalid, the rest remains in force and the provision is replaced by a valid one closest to its purpose. Bottles may assign these Terms to an affiliate or a successor in its business, with notice to you. You may not assign your account or your rights under these Terms. A failure by Bottles to enforce a provision, or to apply a check or measure in a particular case, is not a waiver of it. Sections 8, 11, 16, 17, 19, 20, 21, 22 and 24 survive the closure of your account. These Terms, with the policies they incorporate, are the entire agreement between you and Bottles about the Platform.
